This SMS / MMS Privacy Policy (“Policy”) describes how Synergy Search (“we,” “us,” or “our”) collects, uses, discloses, and protects your information when you opt in to receive text messages (SMS or MMS) from us. By consenting to receive messages, you agree to this Policy.

Scope & Purpose

This Policy applies specifically to our A2P (Application-to-Person) messaging program (SMS and MMS) – i.e. communications we send from our systems to your mobile device.

It complements (but does not replace) our main organizational Privacy Policy, where applicable.

Its purpose is to fulfill carrier, regulatory, and industry obligations (e.g. CTIA, 10DLC) and to transparently inform you how your opt-in data will (and will not) be used.

Information We Collect

When you opt in to our messaging program, we may collect:

  • Mobile Contact Information: your mobile phone number
  • Opt-in Metadata: date/time of consent, IP address (if applicable), source of consent (web form, verbal, etc.)
  • Message Interaction Data: e.g. dates/times messages were sent/received, replies or keywords (e.g. “STOP”), delivery status
  • Optional Voluntary Info: if you voluntarily provide additional information (e.g. name, preferences) in sign-up or response, we may collect that too

We collect this information only to the extent needed to manage and deliver your messaging services, maintain records of consent, and support your preferences.

How We Use Your Information

We may use your information for the following purposes:

Messaging Delivery & Management

  • To send you SMS/MMS messages (transactional, informational, or promotional) you have opted into
  • To manage opt-outs, re-subscriptions, and message preferences
  • To monitor message deliverability and manage any errors

Service Improvement & Analytics

  • To analyze aggregate message engagement (e.g. reply rates, timing)
  • To refine message content, timing, and provide better user experience

Compliance, Legal & Security

  • To respond to legal requests, prevent fraud or misuse, enforce our rights
  • To maintain records of consent to comply with applicable laws and carrier/industry requirements

Customer Support

  • To support user inquiries relating to messaging (e.g. “help”, delivery issues)

Disclosure & Sharing of Information

We will not sell or rent your mobile information (including your opt-in data) to third parties for marketing or promotional purposes.

However, we may disclose your information in the following limited cases:

  • Service Providers & Subcontractors: We may share data with trusted vendors necessary to operate the messaging system (e.g. SMS aggregators, carriers, hosting providers). All such entities are required to safeguard your data and only use it for the contracted purpose.
  • Legal & Compliance Obligations: When required by law, legal process, governmental request, or to protect our rights, safety, or property.
  • Business Transfers: In the event Synergy Search undergoes a merger, acquisition, or sale of assets, your opt-in data may be transferred, subject to this Policy and confidentiality commitments.

Special Carrier / Opt-In Data Disclaimer:
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties except aggregators and providers of the messaging services needed to deliver SMS/MMS. This ensures your opt-in status and mobile number are not used by unrelated third parties for marketing.

Data Security & Retention

We use appropriate technical and organizational safeguards (e.g. access controls, encryption at rest/in transit, secure storage) to protect your personal information from unauthorized access, disclosure, alteration, or destruction.

Although we strive for strong security, no system is perfect; absolute security cannot be guaranteed.

We retain your opt-in and messaging records for as long as necessary to comply with legal, regulatory, or business needs. After that, we securely delete or anonymize the data.

Your Rights & Choices

You have the following rights with respect to your data and messaging:

  • Opt-Out / Unsubscribe: You can stop receiving SMS/MMS messages at any time. Typically, reply STOP to any message. After you opt out, we will send a confirmation (where permitted) and cease further messages.
  • Rejoin / Resubscribe: After opting out, you may rejoin by signing up again (e.g. via web form, keyword, etc.).
  • HELP / Support: Reply HELP (or the designated keyword) for assistance or contact our support at [support email or phone].
  • Access / Correction / Deletion: You may request access to, correct, or delete personal data we hold about you by contacting us (see Section 8).
  • Changes to Preferences: You may update your message preferences or contact number via our opt-in portal or by contacting support.

Messaging Terms, Costs & Frequency

  • Message & Data Rates May Apply: Message and data rates may be charged by your mobile carrier; those fees are not controlled by us.
  • Frequency: The number of messages you receive may vary. We endeavor to limit volume to what’s reasonable and aligned with your opt-in preferences.
  • First Message Identification: In many cases, we will clearly identify the originating organization (Synergy Search) in the initial message.
  • Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Changes to This Policy & Notifications

We may update this Policy periodically (e.g. due to regulatory changes or improvements).

The “Effective Date” at the top will be updated.

Where required by law, we will notify you of material changes (e.g. via SMS or email).

Continued receipt of messages after a change constitutes acceptance of the revised Policy.
